Feta, Prosecco and 394 Other Names: What the Australia-EU Trade Deal Means for Your Brand

By IP Wealth · · 7 min read

If your business, product or range name borrows from a European place or a European food or drink, a new trade agreement is worth a second look. Here is what has changed, who it affects, and the full list of 396 protected names so you can check your own brand against it.

What has actually changed

On 24 March 2026, Australia and the European Union concluded a Free Trade Agreement after eight years of negotiation. As part of it, Australia has agreed to protect a list of 396 European geographical indications, or GIs. A GI is a name tied to a place of origin, think feta, gorgonzola, grappa or prosciutto di Parma.

Two points matter before anyone panics. First, it is not in force yet. The text still has to be signed, expected late 2026 or early 2027, and is likely to take effect around late 2027. That gives brand owners a genuine window to review their position. Second, most of the names are obscure. The majority are regional European spirits and smallgoods that no Australian business uses. The list matters because of the handful of names in everyday commercial use here, and because of what it changes for new brands.

The numbers

The 396 protected names break down as 231 spirits and 165 agricultural goods, mostly dairy and smallgoods. Wine is handled separately: a modernised wine agreement covers more than 1,600 EU wine GIs, so names like Champagne and the wine side of Prosecco sit under that agreement rather than in this list of 396.

What it means for your trade marks

New brands and new filings are the real exposure. IP Australia now weighs all 396 protected names when it examines new trade mark applications. A new business, product or range name that uses, or even evokes, a protected term can run into an objection it would not have faced a year ago. The protection is not limited to exact copies, so a name that merely calls a protected GI to mind can be caught.

Existing registrations are largely safe. A trade mark that was applied for, registered or used before the agreement, and that uses part or all of a protected name, can generally continue to be used and renewed. If you already hold a registration, the sensible step is to confirm and document that position, not to re-file in a hurry.

The practical takeaway: audit the brands you already own against the list, and clearance-check anything new before you commit to it.

The good news: names you can keep using

The deal carved out several terms that have become common names in Australia. These can still be used, provided the use is not misleading:

  • Parmesan stays usable. The agreement confirms "Parmesan" is not treated as a translation of Parmigiano Reggiano, though packaged sales must carry a country-of-origin label.
  • Prosecco can still be used by Australian winemakers as a grape variety name domestically. Its use on exports is a separate matter under the wine agreement and phases out over ten years.
  • Kransky is unaffected by the protection of the Slovenian GI Kranjska klobasa.

There are further carve-outs in the detail, for example "camembert" on its own, "black forest", the "Kalamata" olive variety and the "Penicillium roqueforti" mould.

Grandfathered: protected, but prior users can continue

For eleven commercially significant terms, a business that can prove continuous, good-faith use for at least five years before the agreement takes effect can keep using the term as a "prior user":

Phasing out: a countdown clock

Ten terms can keep being used for a set period and then must stop. If one of these is central to a product you sell, the phase-out window is the time to transition:

Does this touch your brand? A quick self-check

Does your business, product or range name use or evoke a European place, or a European food or drink term? Are you planning a new brand, sub-brand or product line? Do you sell, or plan to sell, into the EU? A yes to any of these is worth a closer look against the list below.

Frequently asked questions

Will I have to change my brand name?

Usually not if your trade mark was applied for, registered or used before the agreement, as prior use is generally protected. The real exposure is new brands and new applications, which are now examined against all 396 names.

Can I still use "parmesan" and "prosecco"?

Yes. "Parmesan" remains usable with a country-of-origin label, and Australian winemakers can still use "prosecco" as a grape variety name domestically. Export use of "prosecco" phases out over ten years under the separate wine agreement.

When does this take effect?

Not yet. The agreement was concluded in March 2026 but still has to be signed, expected late 2026 or early 2027, and is likely to enter into force around late 2027.

Does this cover wine names like Champagne?

Wine GIs are handled under a separate, modernised wine agreement covering more than 1,600 EU wine names. The list of 396 here is spirits and agricultural goods.
