Michelle Calder — Trade Marks Manager

Michelle relocated to the Gold Coast from New Zealand at the beginning of 2013 solely to join the IP Wealth Team. She has a Bachelor of Laws (LLB), Master in Laws with Honours (LLM(Hons)) and a Graduate Diploma in History (GradDip History) from the University of Waikato. She is also a Barrister and Solicitor of the High Court of New Zealand and has successfully completed the Trade Marks Paper of the Patent Attorney Examinations in New Zealand.

She studied IP law at university during her LLB and LLM(Hons). Michelle’s LLM was focused on issues in International IP Law. After completing her legal professional studies she worked at the New Zealand Commerce Commission as a Legal Adviser on an international cartel case before moving to IPONZ, the Intellectual Property Office of New Zealand. She worked there for just over 2 years, gaining extensive experience in Trade Marks.
She holds three certificates in international IP law from the World Intellectual Property Organisation (WIPO) including the Certificate in IP Management and the Certificate in Electronic Commerce and IP.

Michelle is passionate about all areas of Intellectual Property law, but has a special love for trade marks. She firmly believes that all businesses should have the best possible trade mark protection for their brands no matter what their business is. As trade marks are not always straight forward, she has the ability to come up with creative strategies to help get difficult trade marks accepted. Being a former government Examiner, she can conduct comprehensive searches of the Register exactly the same as what the Examiners do when assessing trade marks.

1. Brand creation services, including re-branding of businesses
2. Conducting Trade Mark Registrability and Availability Searches in Australia and overseas
3. Filing Trade Mark Applications in Australia and overseas, including via the Madrid Protocol
4. Advising on, and overcoming, Examination Reports received in Australia and overseas
5. Trade Mark Protection including infringement monitoring of similar marks on the Australian Register and developing strategies to address potential or actual trade mark infringement
6. Trade Mark Oppositions in Australia, including preparing for and attendance at Hearings at IP Australia
7. Removal / Invalidation / Cancellation actions in Australia and overseas
8. Requesting of, or responding to requests for, consent or coexistence
9. Attending to, or assisting with, negotiating settlement of trade mark disputes, including obtaining favourable outcomes for clients in Trade Mark Oppositions and Removal actions
10. Domain name disputes
